Agreement to Terms
By accessing or using Pinkkamii applications or IT services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services. These terms apply to all visitors, users, and others who access or use our services.
Use of Applications
License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use our applications for personal or business purposes in accordance with these terms.
Restrictions
You agree not to:
- Reverse engineer, decompile, or disassemble the applications
- Remove or alter any proprietary notices or labels
- Use the applications for any illegal or unauthorized purpose
- Interfere with or disrupt the integrity or performance of the applications
- Attempt to gain unauthorized access to our systems or networks
Open Source Applications
Some applications (such as Pixel Color Picker) are open source and subject to additional license terms available in their respective repositories.
IT Services Terms
Service Engagement
IT consulting and managed services are provided based on agreed-upon scope of work, timeline, and pricing. Specific terms will be outlined in individual service agreements or statements of work.
Client Responsibilities
Clients agree to:
- Provide necessary access to systems and information
- Respond to inquiries in a timely manner
- Maintain appropriate backups of their data
- Follow security recommendations provided
Payment Terms
Payment terms will be specified in individual service agreements. Late payments may result in suspension of services. All fees are non-refundable unless otherwise stated in writing.
Confidentiality
We maintain strict confidentiality of all client information and data accessed during service delivery. Both parties agree not to disclose confidential information without prior written consent.
Intellectual Property Rights
All content, features, and functionality of our applications and services, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of Pinkkamii and are protected by copyright, trademark, and other intellectual property laws.
For IT services, deliverables and work products created specifically for clients will be transferred to the client upon full payment, unless otherwise specified in the service agreement.
User Accounts and Data
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.
We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent or illegal activities.
Disclaimers and Warranties
Applications: Our applications are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our applications will be error-free, uninterrupted, or free from viruses or other harmful components.
IT Services: While we strive to provide high-quality IT services, we cannot guarantee specific results or outcomes. We are not responsible for issues arising from client systems, third-party services, or factors outside our control.
Limitation of Liability
To the maximum extent permitted by law, Pinkkamii shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
Our total liability for any claims under these terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.
Termination
We reserve the right to terminate or suspend your access to our applications or services immediately, without prior notice, for any reason, including breach of these terms.
For IT services, either party may terminate the service agreement with written notice as specified in the individual service agreement. Client remains responsible for payment of services rendered up to the termination date.
Refund Policy
Applications
Refunds for paid applications are handled according to the platform's refund policy (Apple App Store, Google Play, etc.). Please contact the respective platform for refund requests.
IT Services
IT services fees are generally non-refundable once work has commenced. Refund eligibility will be evaluated on a case-by-case basis for services not yet performed.
Governing Law and Dispute Resolution
These terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.
Any disputes arising from these terms or our services shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in King County, Washington.
Changes to Terms
We reserve the right to modify these terms at any time. Material changes will be notified through our website or via email. Your continued use of our services after changes constitutes acceptance of the modified terms.
Severability
If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
